C-30 - the devil's in the details

"492.1 (1) A justice or judge who is satisfied by information on oath that there are reasonable grounds to suspect that an offence has been or will be committed under this or any other Act of Parliament and that tracking the location of one or more transactions or the location or movement of a thing, including a vehicle, will assist in the investigation of the offence may issue a warrant authorizing a peace officer or a public officer to obtain that tracking data by means of a tracking device."

"(2) A justice or judge who is satisfied by information on oath that there are reasonable grounds to believe that an offence has been or will be committed under this or any other Act of Parliament and that tracking an individual’s movement by identifying the location of a thing that is usually carried or worn by the individual will assist in the investigation of the offence may issue a warrant authorizing a peace officer or a public officer to obtain that tracking data by means of a tracking device.

(3) The warrant authorizes the peace officer or public officer, or a person acting under their authority, to install, activate, use, maintain, monitor and remove the tracking device, including covertly."

So if you have committed or will likely commit a crime/go against ANY Act of Parliament, you may be tracked. If you breeze through a stop sign or exceed the speed limit, that counts, however unlikely it may be that you'll be tracked you'll be under C-30's reach.

It only has to assist with the investigation of such an offence - that means to prove facts, not necessarily come up with a conviction. If they can rule you out then that aids an investigation but can still keep tabs on you for a year or more.

Pretty nefarious. Looks like I'm with the terrorists and child pornographers on this one.

It can and will if it is found that the bill is unconstitutional... that said, we need a change of government for that to happen, and with the shoot-yourself-in-the-face attitude of Canadian voters that seems like a distant future. Even with elections fraud all but tied to the Party I doubt they'd lose an election any time soon.

Kady O'Malley noted on The House how Vic Toews wants an investigation into Anon, Del Maestro wants to haul Adam Carrol to uncover a widespread Liberal conspiracy to discredit Vic Toews. She noted that the actual bill C-30 is nowhere at present. This might get shelved until the hubris subsides...if it does that is.

I could see the issue go away if something else turned into a hot button media story or if something else seems more urgent to the average Canadian.

I haven't seen this particular point brought up anywhere else, only the 'internet spying' aspect of it.

If you're into writing emails/letters this is pretty important. If you're just into sending them then get to me and I can send you the one I sent out.

If you're just into telling people about issues in hopes that they'll write letters than please share this information. Nobody's spinning this as anything more than an internet spying bill. Government agents planting bugs in your clothes and tracking your car isn't anywhere in the media.

Now that it's spelled out in projected legislation, plain as day, this should be a red flag for Canadians to make some noise and vote accordingly next election if they believe it has any potential to work, even in theory.
