Illegal-Search-Ecstasy

REGINA -- It appears an Ontario man who had 38-thousand ecstasy pills in the trunk of his rental car is off the hook.

Saskatchewan Justice Eugene Scheibel says charges against Frank Clarke Basta will be stayed because police violated his Charter rights in searching the vehicle.

Basta was charged with trafficking and possession for the purpose of trafficking in June, 2002.

A Moosomin, Saskatchewan Mountie stopped a vehicle on the Trans-Canada Highway after checking the plate and failing to find a registered owner.

The officer arrested Basta when he checked his licence and found it was invalid.

He then searched the car and found the drugs -- worth about a (m) million dollars on the street -- hidden in the trunk.

But the judge agreed with Basta's lawyer that the officer didn't have proper grounds to arrest on the licence offence.

Charges that are stayed can be reactivated within 12 months, but rarely are.
