Phish front man spends 3 days in jail

FORT EDWARD - NewsChannel 13 has learned that former Phish front man Trey Anastasio recently spent some more time behind bars in Washington County.

Anastasio avoided jail time last year by pleading guilty to a felony drug charge. The 42-year-old guitarist and singer admitted to driving while under the influence of drugs in Whitehall in December 2006 and was sentenced to participation in Washington County's drug court program.

NewsChannel 13 has learned that the rocker, who now lives in Saratoga Springs, was sanctioned by the drug court last week and ordered to spend three days in the Washington County Jail.

A participant in drug court can be sanctioned and sent to jail for a number of reasons, including failing to show up for the program, showing up intoxicated or failing a court-ordered drug test.

Anastasio admitted to being under the influence of drugs and alcohol when he was pulled over by Whitehall police. He had Vicodin, Percocet, Xanax and heroin in his car.

This story was corrected at 3:10 p.m. to reflect he was sentenced to two days in jail, not three.

The former lead singer of the rock band Phish spent two days in Washington County Jail last week after he was found to have violated the conditions of his participation in Washington County Drug Treatment Court.

Ernest "Trey" Anastasio was in the county jail from Jan. 16 through Jan. 18 after he was sanctioned for an unspecified violation of his drug court contract.

Washington County Sheriff Roger Leclaire said Anastasio’s two days were uneventful, and that he spent them in general population.

Leclaire said his office was not told what Anastasio’s violation was for. Efforts to reach others involved with the program Wednesday afternoon were initially unsuccessful.

Anastasio, a resident of Saratoga Springs and Richmond, Vt., was ordered to participate in the program after pleading guilty to illegally possessing painkillers for which he didn’t have a prescription, when pulled over for a traffic violation in Whitehall on Dec. 15, 2006.

The Post Star is reporting some additional details concerning Trey Anastasio’s recent incarceration. As previously reported, last week Anastasio spent two days in an upstate New York jail, but has since been released. According to the Post Star, Anastasio’s recent incarceration stemmed from his missing a court-ordered counseling session as part of his participation in Washington County Drug Court. The article also says that the third-party counseling session did not involve a drug test.

"From my perspective, he's done very well in the program," Washington County Assistant District Attorney Tony Jordan told the paper. "He's been moving right along and is on track to graduate.†The article went onto say that Anastasio has passed all his drug tests since pleading guilty to a felony charge of fifth-degree criminal possession of a controlled substance.
