Anastasio avoided jail time last year by pleading guilty to a felony drug charge. The 42-year-old guitarist and singer admitted to driving while under the influence of drugs in Whitehall in December 2006 and was sentenced to participation in Washington County's drug court program. NewsChannel 13 has learned that the rocker, who now lives in Saratoga Springs, was sanctioned by the drug court last week and ordered to spend three days in the Washington County Jail. A participant in drug court can be sanctioned and sent to jail for a number of reasons, including failing to show up for the program, showing up intoxicated or failing a court-ordered drug test. Anastasio admitted to being under the influence of drugs and alcohol when he was pulled over by Whitehall police. He had Vicodin, Percocet, Xanax and heroin in his car. Efforts to reach others involved with the program Wednesday afternoon were initially unsuccessful.Anastasio, a resident of Saratoga Springs and Richmond, Vt., was ordered to participate in the program after pleading guilty to illegally possessing painkillers for which he didn’t have a prescription, when pulled over for a traffic violation in Whitehall on Dec. 15, 2006. As previously reported, last week Anastasio spent two days in an upstate New York jail, but has since been released. According to the Post Star, Anastasio’s recent incarceration stemmed from his missing a court-ordered counseling session as part of his participation in Washington County Drug Court. The article also says that the third-party counseling session did not involve a drug test. "From my perspective, he's done very well in the program," Washington County Assistant District Attorney Tony Jordan told the paper. "He's been moving right along and is on track to graduate.†The article went onto say that Anastasio has passed all his drug tests since pleading guilty to a felony charge of fifth-degree criminal possession of a controlled substance.
