Inside the box, under the doll’s head, were three pounds of marijuana. Rowan County detectives say the drugs landed at the wrong house. According to investigators, the girl’s mother bought the doll from an auction on eBay. When it was delivered to her apartment, it looked just like it had come straight from the manufacturing plant, so she wrapped it and put it under the tree. The mother called 911 on Christmas Day when she realized what was in the box. Capt. John Sifford of the Rowan County Sheriff’s Department said hiding the drugs in merchandise is just another way to move them. “Drugs are sent through the mail, various services,†he said. “Apparently this mail was meant for someone else.†Authorities said the marijuana is worth more than $7,000 on the street.

From 7 p.m. until 11 p.m. (EST), North Carolina radio station WNCW-FM will be rebroadcasting Haynes’ Pre-Jam Jam that took place December 15 at the Orange Peel club in Asheville, NC. Folks not located within the listening area of the station can stream the broadcast online at www.wncw.org. The Pre-Jam Jam was just that, a warm-up to Haynes’ 18th Annual Christmas Jam, which was held the following night at Asheville’s Civic Center. At that seven-hour concert – a benefit for the local chapter of Habitat For Humanity -- all the above-mentioned artists performed along with a host of others including Dave Matthews (whose presence on the bill was largely responsible for the Jam selling out almost instantly). But the Pre-Jam Jam, scaled-back somewhat setwise but benefiting from the intimacy of a club and an invite-only affair, was a special event indeed. It ran from about 6 p.m. until 12:30, and WNCW broadcast it live; set changes have been edited out of the rebroadcast, hence its running about four hours now. HARP was on hand for both the Pre-Jam Jam and the Jam and will be posting a review on our website very soon. Meanwhile, you can get an aural taste yourself by tuning in Saturday night.   7. Yes, but the drag is that with all the venues around the Toronto Harbour, it's the residents on the Toronto Island that are the cause for the curfew (Molson Amph, Olympic Island, DuMaurier Stage, The Docks, etc.) It should be allowed to be later, IMHO. The Island is a park for EVERYONE.

Wolfgang's Vault responds to suit filed by Grateful Dead, others December 27, 2006 10:39 AM by Tjames Madison LiveDaily Contributor The owner of a rock memorabilia website has responded to accusations raised against him by a lineup of music icons that includes Grateful Dead Productions, Carlos Santana (music), The Doors (music) and Led Zeppelin (music). William Sagan, who owns and operates wolfgangsvault.com, is being accused by the music legends of unlawfully reproducing and selling vintage concert memorabilia and illegal copies of unauthorized trademarked items belonging to the plaintiffs. "The lawsuit has nothing to do with artists' rights and everything to do with others in the industry seeking to seize profits and shakedown Wolfgang's Vault and its owner, Bill Sagan," said Sagan's attorney, Michael Elkin, in a press release. The lawsuit, filed earlier this month in San Francisco, seeks to stop Sagan from selling these materials in what the lawsuit claims is a violation of federal and state laws. Sagan acquired the memorabilia when he purchased some of the late concert promoter Bill Graham's assets from Clear Channel Entertainment, which had purchased Graham's company following its founder's death. Graham's legendary archives included concert posters, T-shirts and other items which the lawsuit claims were never authorized for sale. "We believe while this lawsuit will attract a lot of headlines it has no basis or fact in law whatsoever," Elkin said. "Wolfgang's Vault bought all of this decades' old material legally, paid their rightful owner and own all the rights necessary to conduct its business. We fully expect to be victorious in the court of law." The attorneys representing the rock legends claimed earlier that Sagan never purchased the right to sell or distribute the memorabilia when he acquired Graham's former assets. "Sagan simply doesn't have the legal rights to exploit and profit from the extraordinary success of these musicians," said attorney Jeff Reeves, who represents the musicians in a press release. "This memorabilia was created in the first place for the purposes of promoting concerts and as gifts for fans and concert crew. Graham himself did not have the right to sell, reproduce or otherwise exploit these materials as a promoter, and neither does Sagan, who was not authorized to purchase these materials and who has absolutely no connection to the artists or their music." Sagan's attorneys argue that the acquisition of Graham's archives included the implicit right to dispose or sell of the material as the new owner saw fit. "The industry is never happy when fans can get music for free. Yet millions of dollars were spent for Mr. Graham's archive, and that purchase price included not just the photography, posters and handbills but also the recordings, as invaluable and as irreplaceable as they all are. Furthermore the purchase allowed the company the rights to open the archive as they deemed fit. Wolfgang's Vault is determined that the vault remains open, and intends to do everything in its power to keep it that way," added Elkin. "We have never given permission for our images and material to be used in this way," said the Grateful Dead's Bob Weir in the release. "What Sagan is doing is stealing. He is stealing what is most important to us--our work, our images and our music--and is profiting from the good will of our fans." Recently, Sagan bid the winning amount--$3.8 million--in an October bankruptcy auction to acquire Tower.com, the web address of West Sacramento, CA-based Tower Records, which filed bankruptcy this year and is now out of business in the US. The deal is currently in limbo after Tower filed court papers later in October, claiming Sagan was trying to back out of the deal or renegotiate the terms.

You did one of the hardest things somebody can do, but you did it because of your compassion and love for your dear 4-legged friend. This may be a little corny to some, but it always gets me when i think of the loss of a pet: The Rainbow Bridge Just this side of heaven is a place called Rainbow Bridge. When an animal dies that has been especially close to someone here, that pet goes to Rainbow Bridge. There are meadows and hills for all of our special friends so they can run and play together. There is plenty of food, water and sunshine, and our friends are warm and comfortable. All the animals who had been ill and old are restored to health and vigor; those who were hurt or maimed are made whole and strong again, just as we remember them in our dreams of days and times gone by. The animals are happy and content, except for one small thing; they each miss someone very special to them, who had to be left behind. They all run and play together, but the day comes when one suddenly stops and looks into the distance. His bright eyes are intent; His eager body quivers. Suddenly he begins to run from the group, flying over the green grass, his legs carrying him faster and faster. Keelin Noel Garcia, a 19-year-old college student living in Marin, names Deborah Koons, Garcia's wife when he died in August 1995. She also names attorneys David Hellman, Richard Riede and Neil Moran, all of whom practice in San Rafael, claiming that child support payments that should have been made to her were not allocated properly. William Romaine, Keelin's Visalia-based attorney, said Jerry Garcia's will clearly states that Keelin's support should be taken care of before the remaining assets were split by beneficiaries. "Deborah Koons, a trustee, had the highest possible duty to provide it at her expense," Romaine said. "Instead, she profited from it." Romaine cites the will of Jerome J. Garcia, stating: "After payment of all my debts, my last illness and funeral expenses, and provision for my child support obligations for Keelin Garcia É my executor shall divide and distribute the remainder of my estate." Romaine said that while the case was in mediation, attorneys for Koons and Keelin's court-appointed guardians came up with a low amount of child support at a time when the estate was making huge amounts of money. "The trustees are supposed to look after her support," Romaine said. Hellman, who wrote Garcia's will, said the probate court oversaw the entire process of distributing the estate - valued in 1998 at more than $15 million - and support for Keelin Garcia was covered at the time. "We'll see where it goes, but it appears those issues were covered in the probate court," he said of the allegations. Riede and Moran are listed as guardians for Keelin Garcia in her lawsuit. The estate was admitted to probate in Marin Superior Court in September 1995 and closed in October 2001. Under the will, a third of the estate was given to Koons and the remaining two thirds were shared by Garcia's daughters, brother and friends. Keelin Garcia was allotted one-fifth of the inheritance, like her sisters. Keelin is Garcia's youngest daughter from his relationship with Menasha Matheson. He had three other daughters: Heather, his oldest, from his first marriage, to Sara Ruppenthal, and Theresa ("Trixie") and Annabelle, from his marriage to Carolyn "Mountain Girl" Adams. In her lawsuit, Keelin claims the defendants breached their fiduciary duties on her behalf. She asks for unspecified damages. A court hearing is scheduled for March 5. December 26, 2006 By Eydie Cubarrubia The Grateful Dead were once lauded for allowing fans to record and share concerts for free. Now the band is part of a “shakedown,†a memorabilia website said Monday. Members of the Dead, as well as musicians from Led Zepplin, The Doors, and Santana, filed a lawsuit last week against Wolfgang’s Vault claiming the site was illegally streaming vintage concert recordings (see Rock Bands Sue Online Archive). Legal representatives for the website, however, said the lawsuit had nothing to do with illegal sharing or downloads. “Wolfgang’s Vault brought all of this decades’-old material legally, paid their rightful owner and own all the rights necessary to conduct its business,†attorney Michael Elkin of the law firm Thelen Reid Brown Raysman & Steiner said in a press release. The lawsuit—filed in San Francisco in the United States District Court of the Northern District of California—represents a new twist in the digital music wars. Despite the success of music sharing as viral marketing, many popular musicians and major labels worry that digital availability could cut into revenues. That’s not a frivolous concern, since the International Federation of the Phonographic Industry reports that CD sales fell to $17.02 million in 2005 from $18.11 in 2005 while physical single sales fell to $721 million from $821 million. “The lawsuit has nothing to do with artists’ rights and everything to do with others in the industry seeking to seize profits and shakedown Wolfgang’s Vault and its owner, Bill Sagan,†Mr. Elkin said. He claimed that Wolfgang’s Vault owned the right to use its archives as it sees fit. But musicians have claimed that they should have final say regarding the way their work or images are used. “What Sagan is doing is stealing,†said Bob Weir of the Grateful Dead in a statement. “He is stealing what is most important to us—our work, our images, and our music—and is profiting from the good will of our fans.†Added Carlos Santana in a statement: “Bill [Graham, who originally owned the Wolfgang’s material] was a close friend to me and the Santana Band for many years, and I know that what Sagan is doing would go against everything he believed in.†The whole thing could boil down to a generation gap. The Dead famously allowed fans with recording equipment to document live shows and share with fellow fans—but those were hard copies, such as cassette tapes, that were the latest technology during the heydays of that and other bands. There’s always hope that the lawsuit could be resolved amicably. Take the Beatles, which has often battled computer-maker Apple for having a name and logo similar to the Fab Four’s own distribution company. After their latest spat, many reports began to emerge that the Beatles could, finally, start to sell downloads of songs through iTunes (see I Wanna Hold Your…iPod?). Maybe they got wind of the fact that, according to the IFPI, digital sales grew 188 percent from $397 million in $2004 to $1.14 billion in 2005. Those figures could help foster better cooperation between vintage bands and online sources. All you need is love—at least, love of money.
