The main function of the rule is to make sure that the hypothetical 12 song CD we're compling could actually be compiled from official sources. Also so that they don't just become "fantasy" albums, people listing tracks that simply don't exist apart from their own stoned imaginations. If however the theme was "Black Crowes versions of cover songs" then you'd have to ensure the Crowes have indeed released a version of it, officially and not just in trader's circles.
