  5. Perhaps the issue of sentencing is regarded by judges as how likely a person is to be of detriment to themselves and those around them. A cold blooded murderer may feel less remorse than a drunk driver and may be more likely to commit many different crimes to either fulfil some sociopathic intent or to reinstatutionalize him/herself while a drunk driver may eventually repeat his/her crime, it is unlikely s/he will kill again while doing so. Perhaps the shock of jail will make him/her think twice about not arranging a ride home after a trip to the bar. So if sentencing is paying for an action rather than paying for its outcome then that would explain the point of view of the judges' 'joke' sentences. I don't really think there's truly a way for someone to pay for the life of another, even in death, So 5 years seems short to me. Thinking about paying for killing someone else while the action was not to kill that person but was the outcome. I don't expect to ever be a judge as it is difficult to separate reason from emotion in cases like this. Perhaps people don't appreciate me not coming down hard on drunk drivers as the rest of society would in a thread like this, but what kind of discussion would there be if everyone just had the same thing to say? And of coming down a bit firm on the emotional responses everyone has after reading about a case as this might seem opportunistic and heartless to some, but there are a lot of social misjustices that are happening on all sides of issues. While I don't intend to change peoples' points of view, it is necessary for someone to voice that change is needed. Maybe I'm not the best person to do it but nobody else seems to voice that there's something wrong, instead people assert that the courts and offenders are the only ones that are wrong. That formula isn't solving anything. Luckily, a joystick isn't as apt to offend a person's sensibilities as much as any number of other things. Cause after all's said and done you can always have a game of asteroids.

  8. I forgot to separate intent from premeditation. In the heat of a moment someone can intend to inflict serious harm, but to think about it befgorehand and plan it out makes the difference. Velvet, I think PT has explained his position as both are potential deadly weapons...although there has to be more to it than that. And, PT - I'm not saying that we should pin it on all of us that this bullshit killing happens, but seeing that it's the 21st century and it's a world of enormous riches (and we're part of the G8) that there must be a way to do more to solve the problem than merely hand out fines and demoralize people because of the poor choices they are unable to make clearly. Educating people about the risks and outcomes aren't giving people other options in the heat of the moment. There's nobody stopping drunks from driving. The options are available, but turning our backs just because we can only to turn around again and wag a finger obviously doesn't work. I'm not expecting anyone here to implement a strategy to prevent more drunk drivers from getting in their cars, but at least I recognize that it takes more than shock ads and deaths for people to smarten up about it. Anybody else? Perhaps some of our enormous sin taxes on alcohol could go toward anti drunk driving initiatives around the country...like an operation red nose all year long? Perhaps it takes breathalyser machines in every car that lower our insurance rates to almost nothing? Perhaps tax breaks or payback incentives on cab rides home? Whatever it's going to take it will be entirely costly and a headache to implement. Perhaps that's part of the reason so many are quick to turn their backs in disgust. One thing I do know is that in most communities people mostly drive to the bar or restaurant where they consume alcohol. Many people feel safe driving their car/truck home but nobody checks to see their BAC before they're allowed to drive. I wonder how often people drive drunk over the legal limit. I presume it's quite often. Should there be RIDE programs most nights in the summer? Should RIDE programs have mandatory breathalysers? Do you hope they don't implement that?

  11. Drunk driving is NOT the same as randomly firing a machine gun into a crowd. Both are ridiculous acts, but they are NOT the same thing. To suggest they are is sensationalizing the issue and only serves to distract people from thinking clearly about any of it. If you're defending the victim try not to confuse the issue. Perhaps a reason Quebec judges are light on repeat offenders is that the side of victims of drunk driving has a bunch of 'clever' comparisons while most of the killers/could-be-killers need rehabilitation once their sentences are over. It would seem that Judges are a bit more sympathetic to realistic explanations of events and personal situations. It would be very difficult for me to keep my composure if my kid were mowed down by a repeat drunk driver...if I had a kid of course. I sure hope that our society can find ways to give would-be drunk drivers other better options than to drive home drunk. There are many lame excuses these folks would have - taxis are too expensive, no time in the morning to get their vehicle, etc... They're still used and nobody's stopping these people from getting in their cars and driving. is prevention even all that possible?

He was careless and acted unjustly but his actions don't line up with 'murderer' he didn't intend to take her out with his truck, but I think his sentencing is far too light. Pretty understandable conclusion for a EIGHTH GRADER though so I can't take it so hard.
  15. so that's the breakdown of the crime, but the definition of a person as murderer or killer is really what this is. Someone that steals isn't necessarily a thief. Someone that gets in a fight isn't necessarily a brawler someone that plays guitar isn't necessarily a musician. Someone that uses heroin isn't necessarily a junkie. I guess it depends on how you label people... Depending on the dictionary and the breadth of the explanation you demand from a dictionary, a murderer can be someone that commits murder but it's more than definitions and blame when we're talking about the passing of a life. After all, we're supposed to rehabilitate these killers so they can come out of jail as a functional member of society. Writing them off would lead them right back to the bottle and every time that happens and you read about a repeat offender just think of the essence of your thoughts and how your intentions are very powerful unless of course you're an atheist. I'm not. There's something more important than the rules of man and THAT is the reason to not want to plow someone down with your car or cause harm to others. A careless act of ignorance and apathy is not a vicious, destructive, ruthless, evil one. that's why it's second degree murder...because there is logic involved in handing down a sentence - adding moral weight to carelessness. But to let it all get out of hand and attest that this person intended to kill someone when s/he drove drunk is a stretch and that's where your personal definition of murderer comes into play. that is, of course, assuming your definitions are personal...which it certainly seems. I try to be a bit more neutral about it. It lessens my murderous cravings. Otherwise I wouldn't be drunk when I'd be driving the car that'd plow him down when he's riding his bike to work. THAT would be murder and as much as some people think it's a logical bit of retribution, Nobody needs that.
  16. pushing someone off a cliff is an intentional act of shoving rather than merely knocking them off because they're clumsy. not intentional. not murder. Candians want retribution and someone to be fully accountable and pay dearly for improper action...Murder sounds better and keeps us satisfied. shooting is pulling the trigger...now say they were at the shooting range and he was wasted and forgot to lower his arms and stop continually shooting while turning around...that's about the only way that could be compared, Sharon. I'm not in any way definding drunk driving but I do think it's important to truly understand the concept of murder and the approach we have to logic. Although the system in place that most people have works and fosters morality, it's the tiny details that open up hige rifts between reality and societally-imposed logic. He still killed them. He was a stupid fucker for getting behind the wheel drunk. Now...say it were a different story...say he happened to be drunk and got into an accident but it wasn't his fault - he'd be branded with the same iron that a drunk driver that actually plowed someone down. In THAT case the guy that was inebriated (wrongfully, but perhaps not at fault in the accident) has 'murderer' hanging over his head (even if he didn't hurt anyone in the accident) Does anyone truly deserve to have that hanging over their head (even if they hang it there themselves) when if it's not their fault that they got t-boned going through a green light? Perhaps it's not crucial that true objectivity be exercised at all times but many people succumb to their emotions while trying to apply logic to a situation. People die every day. Loss is unfortunate. We must move on fairly and justly. Retribution must be done properly and although there's no heavier sentence than 'murder', it is entirely unfortunate that many of the sentences we have are not heftier. Manslaughter (aggraved manslaughter?? someone help me out here) could definitely carry heavier sentencing. thanks, QQC - Call it murder if you wish but it's not murder and we all deserve to be dealt a fair hand.

  18. Leavin' train and the Stowaways Caught them in Kemptville this weekend and dig what I heard. Definitely not very rough around the edges, but man oh man that dobro and mando! I had a hard time getting the system to pick up the upright on a mic. Doing sound is fun. I wasn't and it was a great sunny sunburny day. I am so at home with my farmer's tan. I wholly suggest anyone try Beau's Beer. It's a great organic brewery from Vankleek Hill. There was an act that was called 'the Hobo Saints' that played as well...an an acoustic trio - guitar, mandolin, and snare drum - that were solid. Although I couldn't get over how the guitar sounded like the HipHoppapotamus (thank you flight of the conchords) it was a tight act that apparently plays around Ottawa. Anybody know of these guys? I was so glad to meet up with the Barn crew again (freephonic/Grand National/Caution Press etc.) and catch their set. They've got a really familiar sound. Their rhodes player Ben Mullin really gets me into that 70's pop hit factory nostalgia and Robin Stewart's tight bass pumps out some of the juiciest flatwound power around. I sure hope they play another show around soon. Vegstock Facebook link I also hope that the Branch has more shows like this more often in the summer. It was such a great use of the corner of Clothier and Prescott Streets...a resto-bar and an irish pub almost beside oneanother, the whole main street area closed off during the day, loads of foot traffic and a completely rejuvenated downtown. Kemptville is finally a nice little town and it's easier to get to than the east end of Ottawa if you're driving. It takes me less than 45 minutes to get right downtown, park and wherever I need to driving the speed limit and I live 10 minutes PAST kemptville.
